These Terms of Service govern access to and use of SparkyHub. By creating an account, accessing the platform or using any part of it, you agree to these terms on behalf of yourself and the company you represent.
About SparkyHub
SparkyHub is a business management and organizational platform for electrical and construction contractors. It provides tools for organizing projects, people, scheduling, time records, safety documentation, purchasing, job costing, reporting and related business information.
Accounts are issued to a company. The company is responsible for the users it authorizes, for the access it grants them and for their activity on the platform.
User Responsibility and Limitation of Liability
Users are solely responsible for the accuracy, completeness, legality, reliability and appropriateness of all information, data, documents, files, records, calculations and other content entered, uploaded, generated, stored or otherwise provided through SparkyHub.
SparkyHub is provided as a business management and organizational tool and is not a substitute for professional judgment, regulatory compliance, legal advice, accounting advice, engineering services, safety procedures or other professional services. Users remain responsible for reviewing and verifying information produced, calculated, displayed or stored through the platform before relying upon it.
To the maximum extent permitted by applicable law, SparkyHub and its owners, directors, employees, contractors, affiliates and service providers shall not be liable for any loss, damage, cost, expense, business interruption, loss of profits, loss or corruption of data, project delay, financial loss, property damage, injury, claim or other consequence arising from or relating to the use of, inability to use, or reliance upon SparkyHub or information entered into, generated by or obtained through the platform.
Users are responsible for maintaining appropriate records, backups, approvals, supervision and verification procedures for their business and projects and for ensuring their use of SparkyHub complies with all applicable laws, regulations, codes, contractual requirements, workplace requirements and company policies.
Nothing in these terms excludes or limits liability where that liability cannot lawfully be excluded or limited.
Construction and Electrical Work
SparkyHub does not certify or guarantee that information, forms, reports, calculations, safety documentation, project records or other outputs produced through the platform satisfy applicable electrical codes, building codes, occupational health and safety requirements, contractual requirements or other regulatory obligations.
SparkyHub is a management tool. The contractor and its authorized users remain responsible for reviewing work, determining code compliance, obtaining required permits, inspections and approvals, following applicable safety requirements, and assigning appropriately qualified and licensed personnel.
SparkyHub does not provide engineering, legal, accounting, safety or regulatory advice, and no output of the platform should be treated as such advice.
Information You Enter or Upload
The customer company and its authorized users are responsible for the information they enter into or upload to SparkyHub, including:
- project information and project records
- employee and personnel information
- time records and manpower information
- safety documentation, including FLHAs and related forms
- purchasing records, supplier and subcontractor information
- financial, job cost and billing information
- documents, photographs, attachments and any other customer-provided content
Rights and Authority to Provide Information
Users must have the necessary authority, rights, consents and permissions to upload, store and process the information they provide to SparkyHub, including any personal information about employees or third parties.
Users must not upload content that is unlawful, infringing, malicious, or that they are not permitted to disclose.
Accounts and Access
Users are responsible for keeping their login credentials confidential and for all activity carried out under their account. Company administrators are responsible for granting, reviewing and removing access for their users.
Access may be suspended where use of the platform is unlawful, abusive, or presents a security risk to other customers.
Beta Program
While SparkyHub is offered as beta software, the separate Beta Software Notice also applies. Acceptance of these Terms of Service does not replace that notice, and the notice does not limit these terms.
Service Availability and Changes
SparkyHub may add, change, suspend or remove features, and may update these terms. Where a change to these terms is material, the terms version will be incremented and users will be asked to review and accept the updated terms before continuing to use the platform.
Termination
A company may stop using SparkyHub at any time. On termination, users remain responsible for retrieving and retaining their own business records in accordance with their legal and contractual obligations.
Governing Law
These terms are governed by the laws of the Province of British Columbia and the applicable laws of Canada, without regard to conflict-of-laws principles.
